Sex Crime

Sex crime is a difficult case for both victims who suffer from severe wounds and
suspects who suffer from unfairness due to unintentional circumstances. Hanmi Law firm will do its best

    Sexual Violence

    Sexual violence refers to the sexual abuse including physical, verbal and
    psychological harassment, and it is a crime under criminal law,
    act on special cases concerning the punishment of sexual crimes, act on
    the protection of children and youth against sex offenses

    Sexual violence also
    includes rape or forced assault, pornography, filming or distributing of pornography
    using digital devices, and pornographic messages.

    The most important thing to do when sexually harassed is to keep all evidence,
    including clothes and objects of that particular incident and
    to go through hospital check up before showering.

    Prostitution

    It is defined as a sexual activity including sexual intercourse, non-penetrative intercourse, and any other activities using body part such as mouth or
    anus in purpose of receiving money, valuables or other property gain

    Non-penetrative intercourse using mouth and hand is also an act of prostitution, and its arrangement is also prohibited strictly by law. The person who has
    violated may be subjected to "more than one year of prison or up to
    three million won penalty".

    In the case where subject of prostitution is a child or an adolescent under the age of 19, the person will be subject to "up to 5 years of prison or a 30 million won fine"

    Sexual Assault and Harassment

    Sexual assault and harassment are criminal acts that induce sexual shame
    through physical or psychological means for sexual satisfaction.

    Not only women but also men can be subject to these crimes.
    The victim should sue at the investigative agency so that the suspect can be
    punished, which is known as an offense subject to complaint.
    You may issue an indictment after lawsuit is proceeded.

    The best solution is to have an amicable agreement with the victim since the crime
    will be followed by severe punishment such as public disclosure of the suspect's
    identity and photo, and attending the educational course on sex crimes prevention.

    adolescent, and it has special provisions regarding punishment and procedures
    for sexual crime.

    Child and Adolescent Act aims to protect child and adolescent from sexual crimes and it systematically controls child and adolescent sex offenders to help children and adolescent grow into healthy individuals of society.
